在宅ロビー活動にご参加いただいている皆様、元徴用工と称する韓国人(実際には募集に応じた労務者)への賠償を日本企業に命じた10月30日の韓国最高裁判決は本当に腹立たしかったですね。安倍総理の怒りのコメントにすべてが集約されています。

「1965年の日韓請求権・経済協力協定によって完全かつ最終的に解決している」
「判決は国際法に照らして、ありえない判断だ。日本政府として毅然と対応していく」

請求権については、あの韓国政府でさえ「解決済」と公式に表明してきました。2005年に日韓協定締結当時の外交文書を公開し、個人に対する補償義務は「韓国政府が負う」と韓国外務省が明言していたことが明らかになりました。公開時に盧武鉉政権は、元徴用工の賠償請求権は日本が韓国に供与した無償3億ドルに「包括的に勘案された」と明言しています。また2009年に裁判所に提出した書類で韓国政府は、「未払い賃金は3億ドルに含まれている。日本政府に請求権を行使するのは難しい」と述べています。文在寅大統領も徴用工問題について「韓日請求権協定で解決済」と発言しています。誰の目にも明らかな話です。それなのに韓国政府は、判決をタテに「司法の判断を尊重する」と言いだしました。

The international order based on the rule of law is under threat by a South Korean Supreme Court ruling that denied the effect of international treaty and ordered foreign companies to pay exorbitant compensation. If the effect of international agreement or settlement were denied, it would open up a Pandora's box and revive old conflicts around the world. I urge the UN to take action.

On 30 October 2018, South Korea's Supreme Court ordered Japanese company Nippon Steel & Sumitomo Metal Corporation to pay compensation to four South Koreans who they claimed were conscripted to work in Japan during the Second World War. It is estimated that three hundred Japanese companies will subsequently be ordered to pay about 20 billion US dollars.

Former South Korean Supreme Court Chief Justice Yang Sung-tae was arrested and indicted on 11 February 2019 on charges that he abused his authority to influence trials as a political tool to lobby the previous government, however, the aforementioned ruling was handed down by Chief Justice Kim Myeong-soo who is close to the current Moon administration.

The Korean peninsula was part of Japan and Koreans were Japanese nationals at that time in accordance with the Japan-Korea Annexation Treaty signed in 1910. Koreans were exempt from military conscription but from 1944 to 1945, some were conscripted as labourers. This issue has been "settled completely and finally." (Article II) by the "Agreement on the Settlement of Problems Concerning Property and Claims and on Economic Co-operation between Japan and the ROK" signed on 22 June 1965, and South Korea received tens of billions dollars in current price from Japan. Both the Japanese and South Korean governments have been insisting that the issue has been settled. The Japanese Prime Minister Shinzo Abe told the media: "The ruling is a judgment that is impossible in light of international law." However, the South Korean government said that they will respect the ruling.

All disputes must end at some point, the international community must pursue peace and reconciliation, and South Korea must not be allowed to set a dangerous precedent.
