★ 金正恩がアメリカの制裁対象に!

北朝鮮は猛反発し、アメリカとの接触ルートである「ニューヨーク・チャンネル」(国連代表部窓口)を完全遮断すると通告しました。さらにミサイルを発射し、核実験を行う構えも見せています。
金正恩への制裁は、国務省報道官が認めているように、他国の政府や金融機関に北朝鮮取引を見直させることが目的の一つです。カービー報道官はハッキリと、
「私たちが行動をとると、つまり誰かを制裁リストに載せると、世界中に波紋を投げかけ、諸外国や国際機関また金融機関が北朝鮮との関係を考え直すインパクトを発生させます」「私が言いたいのは、結果として大きな経済的コストが発生するということです」

またカービー報道官は、「意図しない否定的結果を生む可能性について考慮したか?」との報道陣の質問に対し、
「私たちはこうした決定をするとき、可能な限り多くの事情を考慮します。むろん慎重に審議しました。しかし、もし座ったまま何も言わず何もしなければ、彼(金正恩)に完全に誤ったメッセージを送り、自国民に対し行っている邪悪な行為を続けるよう奨励する結果を生みかねません」
と述べています。
アメリカはやっと気づいたようです。北朝鮮の問題は、脅迫に怯むことなく徹底的に制裁をかけ、体制崩壊か完全屈服を引き出す以外に解決方法はないのです。遅れれば遅れるほど、北朝鮮に時間稼ぎを許し、脅威が増加します。そして中途半端は、北朝鮮に誤ったメッセージを送り逆効果になるだけです。
アメリカの覚悟を歓迎したいと思います。
国連・アメリカ政府認定の凶悪犯罪者
★ モンゴルに北朝鮮労働者1000人以上!
さて、7月中旬にASEM(アジア欧州会合)の舞台となり、世界各国の首脳が集まったモンゴルですが、多くの北朝鮮奴隷労働者を雇用しています。7月7日にウォール・ストリート・ジャーナルは、「モンゴルの首都ウランバートルで、北朝鮮人1000人以上が工場や建設現場、レストラン、医療施設などで働いており、本国の金正恩体制への送金に貢献している」という記事をタイミングよく出しました。下記で日本語版をご覧いただけます。

私のほうではモンゴル大統領、外務大臣、国連大使、駐日・駐米・駐韓大使に書簡とメールを送り、安保理決議やILO条約に違反するので、すぐに北朝鮮労働者を送還するよう求めました。
北朝鮮労働者の賃金支払いは、本年採択された安保理決議2270号に違反します。賃金のほとんどは北朝鮮の39号室に送金されますが、安保理決議は39号室を制裁対象に指定し、一切の金融取引を禁じています。当然のことながら、フロント企業も含まれます。また北朝鮮労働者は奴隷状態で働かされているので、モンゴルが批准しているILO(国際労働機関)の各種条約に違反します。さらに北朝鮮労働者は現金の運び屋をやらされていますが、安保理決議2094号(2013年採択)はそうしたマネーロンダリング行為への徹底取締りを求めています。見て見ぬふりは許されないのです。
国際法遵守の姿勢は、日本政府が諸外国をみるとき重視している事柄です。鈴木宗男議員が平成18年に提出した質問主意書で「国家承認の要件如何」と問うたのに対し、政府は「国の権利義務に関する条約」が定める要件のほかに、「我が国としては、当該主体が国際法を遵守する意思と能力を有しているかについても考慮することとしている」と答弁しました。要は、国際法を遵守しない国は新規に国家承認しない、ということです。これは北朝鮮の国家承認に関する質問主意書なので、北朝鮮が国際法を遵守する意思と能力を明確にしない限り、国交正常化は決してありえない、という内閣の決定でもあります。

首脳会議開催を機に、モンゴルには国際社会の一員として責任ある行動をとっていただきたいと思います。国際法違反は許されません。ただちに北朝鮮労働者を送還するとともに、暴力団交遊のような対北関係を断つべきです。

Paragraph 8 (d) of UNSCR 1718 (2006) decided that all UN Member States must: “ensure that any funds, financial assets or economic resources are prevented from being made available by their nationals or by any persons or entities within their territories, to or for the benefit of such persons or entities;”
This means that the Mongolian government has the duty to prevent Mongolian companies from making payments to North Korean front companies or front organizations.

Mongolia has been a member of ILO since 1968 and ratified all eight ILO Fundamental Conventions. There may be multiple interpretations on ILO Conventions but the use of North Korean workers at least violates 1998 Declaration of Fundamental Principles and Rights at Work which stipulated that: “Declares that all Members, even if they have not ratified the Conventions in question, have an obligation arising from the very fact of membership in the Organization to respect, to promote and to realize, in good faith and in accordance with the Constitution, the principles concerning the fundamental rights which are the subject of those Conventions,”

Mongolia has an international obligation to crack down on North Korea’s money laundering and WMD financing. A report published by South Korea’s government-backed think tank the Asan Institute for Policy Studies stated: “According to the testimony of laborers gathered by the Asan Institute, returning workers also act as mules to carry hard currency earnings back to North Korea, violating the bulk cash ban imposed by the international community to sanction North Korea for its proliferation activities. This implies that North Korea's labor exports lie at the intersection between grave human rights violations and North Korea's WMD program. Accordingly, such human rights violations help perpetuate and support the country's illicit activities and its development of nuclear weapons. ... Their testimonies show that the horrific labor conditions North Koreans suffer overseas are tantamount to slavery, in violation of international law.”

The Financial Action Task Force (FATF) has again placed North Korea (DPRK) on the top of its blacklist. In its Public Statement on 24 June, FATF urged all jurisdictions to “advise their financial institutions to give special attention to business relationships and transactions with the DPRK, including DPRK companies, financial institutions, and those acting on their behalf. In addition to enhanced scrutiny, the FATF further calls on its members and urges all jurisdictions to apply effective counter-measures, and targeted financial sanctions in accordance with applicable United Nations Security Council Resolutions, to protect their financial sectors from money laundering, financing of terrorism and WMD proliferation financing (ML/FT/PF) risks emanating from the DPRK.”

The US Department of the Treasury’s Office of Foreign Assets Control (OFAC) designated North Korean leader Kim Jong Un for his ties to North Korea’s notorious abuses of human rights, including forced labour and abduction, and it would be suicidal for any country to be seen as an ally of the pariah state. The US State Department spokesman John Kirby said in a press briefing on 6 July that: “when we put somebody on a special designation list like this, it does reverberate around the world and it can have an impact on the way other countries or other international bodies and financial institutions consider doing business.”
